REGARDLESS OF THE METHOD(S) OF ENTRY, ONLY ONE (1) ENTRY PER PERSON WILL BE ACCEPTED FOR THIS SWEEPSTAKES.
The "aerie loves paris sweepstakes" ("Sweepstakes") starts at 6:00:01 AM Eastern Time ("ET") on 1/18/10 and ends at 11:59:59 PM ET on 2/15/10 ("Entry Period"). The sponsor of the Sweepstakes is American Eagle Outfitters, Inc., 77 Hot Metal Street, Pittsburgh, PA 15203 (the "Sponsor"). The Sweepstakes shall be subject to these Official Rules and by entering, all participants agree that they have read these Official Rules and to abide by and to be bound by the terms and conditions herein.
ELIGIBILITY: SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA AND CANADA (EXCEPT THE PROVINCE OF QUEBEC), THIRTEEN (13) YEARS OF AGE OR OLDER AS OF DATE OF ENTRY. A PRIZE WON BY A MINOR IN HIS OR HER LEGAL JURISDICTION OF RESIDENCY WILL BE AWARDED IN THE NAME OF SAID MINOR\'S PARENT OR LEGAL GUARDIAN.
Employees of the Sponsor, West Coast Marketing, a division of The Susquehanna Hat Co. ("West Coast Marketing"), their respective parent companies, affiliates, subsidiaries, and related companies and agencies (collectively, the "Promotion Parties"), and their immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the household of same, whether or not related, are not eligible to enter or win. By entering this Sweepstakes, entrants agree to abide by all terms of these Official Rules.
PRIVACY INFORMATION: The information obtained from the entry will be used by American Eagle Outfitters and its affiliates unless otherwise noted by the entrant. For more details, please see our privacy policy at www.aerie.com and www.ae.com. American Eagle Outfitters and its affiliates would like to use submitted information to contact you by mail, text message or e-mail about our special promotions or events. If you prefer not to receive updates of special promotions and/or events, indicate such preference on the Entry Site (as defined below) at time of Sweepstakes entry. False and/or deceptive entries or acts shall render entrants ineligible.
American Eagle Outfitters will not sell, rent, lease or otherwise transfer entrant personal contact information to any non-American Eagle Outfitters company for any purposes other than as required for the administration and/or fulfillment of the Sweepstakes.
The laws of the Commonwealth of Pennsylvania apply to and govern this Sweepstakes and any claims must be raised and resolved in the Federal or state courts located in Allegheny County, Pennsylvania, United States.
All Federal, state, provincial and local rules and regulations apply. Void in Puerto Rico, all U.S. territories and possessions, overseas military installations, the Province of Quebec and where prohibited or restricted by law.
HOW TO ENTER THE SWEEPSTAKES: There are two (2) methods of entering the Sweepstakes; via text messaging entry and online entry.
HOW TO ENTER THE SWEEPSTAKES VIA TEXT MESSAGING:To enter via text messaging, you may enter by text messaging the word "paris" to short code aerie (23743) during the Entry Period. Once you have text messaged as specified above, you will receive a response confirming your entry into the Sweepstakes ("Text Message Entry").ALL TEXT MESSAGE ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON 2/15/10 TO BE ELIGIBLE.
IMPORTANT: For text messaging, a service contract with a wireless Internet or airtime provider may be required. Check with your service provider for availability and coverage. Wireless access point required. Cellular telephone service and/or text messaging services may require separately purchased contracts with a cellular telephone service provider or text-messaging provider with coverage in your service area. Cellular telephone company and/or wireless Internet company determined text-messaging fees may apply for all text messaging to Sponsor or its designee and for receipt of text messages from Sponsor or its designee. In this Sweepstakes you will be sending and receiving messages and you may be charged in accordance with your mobile services contract. HOW TO ENTER THE SWEEPSTAKES FOR FREE ONLINE WITHOUT TEXT MESSAGING:To enter the Sweepstakes without text messaging, log on to the web site at www.aerie.com/paris ("Entry Site") during the Entry Period. Follow the directions for entry in the Sweepstakes; providing your first and last name, street address (no P.O. boxes accepted), city, state or province, country, zip code or postal code, verify age eligibility, daytime phone number, e-mail address, indicating your decision to enter the Sweepstakes and continuing the entry process to its completion ("Online Entry"). Once you have completed the entry process, click the "Submit" button to submit your completed entry. ALL ONLINE ENTRIES MUST BE RECEIVED BY 11:59:59 PM ET ON 2/15/10 TO BE ELIGIBLE.
The Promotion Parties, Internet server(s), Internet and cellular telephone access provider(s), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, "Releasees") are not responsible for: any incorrect or inaccurate text messaging or entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant\'s or any other person\'s computer or cell phone device relating to or resulting from participation in this sweepstakes; inability to access any text message, e-mail connection or web page, theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to cellular device, computer or electronic malfunction or traffic congestion on the Internet or on any web site (including the Entry Site), and/or cellular telephone lines; printing or other errors; problems with transactions and any entries which are late, lost, incomplete, misdirected, stolen, undelivered, mutilated, illegible, or any combination thereof; or theft or destruction or corruption of entries. Proof of submitting a Text Message Entry or Online Entry is not considered proof of delivery or receipt. Illegible, and incomplete entries will be disqualified. All entries become property of Sponsor and will not be returned. False and/or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. By registering to enter the Sweepstakes, entrant affirms that they have read and accepted these Official Sweepstakes Rules.
WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries received. Random drawing will be conducted on/about 2/22/10 by West Coast Marketing, an independent judging organization, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes. Prize winners will be notified as follows: If winner selected had entered via the Text Message Entry method, he/she will be notified within two (2) days of the drawing, via text message notification to the cellular telephone number received at time of Sweepstakes entry. Such winner will be required to respond to this text message notification, as directed, within two (2) days, providing first and last name, date of birth, daytime telephone number and a valid mailing address (no post office boxes accepted) or his or her prize may be forfeited and an alternate winner selected at Sponsor\'s sole discretion. If winner selected had entered via the Online Entry method he/she will be notified within two (2) days of the drawing, via telephone call and/or e-mail notification to the telephone number and/or e-mail address included in the Online Entry. Such winner will be required to respond to this notification within two (2) days, or their prize may be forfeited and an alternate winner selected at Sponsor\'s sole discretion.
Grand Prize winner (or Grand Prize winner\'s parent or legal guardian if Grand Prize winner is considered a minor in the legal jurisdiction in which he or she resides) will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability (a prospective Canadian winner (or his or her parent or legal guardian in the case of a minor winner) will be required to complete and return a Declaration of Eligibility/Release of Liability) and (except where prohibited) a Publicity Release and (for U.S. winner) a completed IRS W-9 form within ten (10) days of date of issuance.
Grand Prize winner\'s travel companion is required to be of majority age or older at time of Grand Prize winner notification or be the minor child or ward of the Grand Prize winner. Grand Prize winner\'s travel companion (or Grand Prize winner if travel companion is the minor child or ward of the Grand Prize winner) will also be required to complete, execute and return a Release of Liability and (where legal) Publicity Release within this same ten (10) day deadline.
First Prizes will be delivered within sixty (60) days of random drawing date by mail or other delivery service selected at the sole discretion of the Sponsor.
If a prospective winner is Canadian he or she will be required to correctly answer without assistance of any kind, a timed mathematical skill-testing question administered by telephone, email or other delivery method selected at the sole discretion of Sponsor.
If a prize notification or prize is returned as undeliverable for any reason, the prize may (at Sponsor\'s sole discretion) be awarded to an alternate winner in a subsequent random drawing. Prize is not transferable, assignable, or redeemable for cash. No substitution for the prize by the prize winner will be allowed. Prize must be accepted as awarded. If necessary, due to unavailability of the prize or parts thereof for any reason, a prize of comparable value will be awarded at the sole discretion of the Sponsor.
All Federal, state and local tax liabilities are the responsibility of the winners. Winner may be required to complete state and federal tax reporting information as a condition of prize receipt. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner\'s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation.
PRIZES: GRAND PRIZE (one [1] will be awarded): The Grand Prize shall consist of a trip ("Trip") for two (2) people to Paris, France ("Paris"). The Trip includes the following: (i) roundtrip ("R/T") economy class airfare for two (2) from the major U.S. or Canadian gateway airport nearest the winner\'s hometown to a Paris airport, (ii) five (5) consecutive nights hotel accommodations (standard room, double occupancy) at a Paris area hotel ("Hotel") and (iii) two (2) $100 USD (approximately $107.15 CAD) aerie Gift Card(s)*.
Specific air carrier(s), destination airport, Hotel, and other Trip specifics detailed above are at the sole discretion of the Sponsor or its designee(s). The approximate retail value ("ARV") of the Grand Prize is $4,000 USD (approximately $4,265.87 CAD). The actual value of the Grand Prize travel may vary depending on city of departure, date and times of travel, airfare fluctuations and hotel charges at the time of travel bookings. Actual value of the Grand Prize awarded may be lower or higher at the time it is fulfilled. Any difference between actual value and stated ARV will not be awarded. All travel is subject to the following restrictions and conditions: All meals, ground transfers, gratuities, excursions, insurance, fees, surcharges, service charges or passenger facility charges, incidentals, departure and airport taxes, passport fees, visa fees and any other expenses not specified herein are the sole responsibility of the Grand Prize winner and his or her travel companion. All travel arrangements are to be administered by Sponsor or its designee(s). Winner will be required to provide forty-five (45) days advance notice of desired departure date and all travel must be completed by 12/30/10. All travel is subject to availability and holiday and other blackout dates apply. Travel must originate and end at the same major U.S. or Canadian gateway airport.
Grand Prize winner and his or her travel companion will be required to travel on identical itineraries including the same departure date, destination and return date. Grand Prize winner and his or her travel companion will be required to provide valid passports at time of travel. No changes will be made to travel details once any element(s) of the travel arrangements have been booked. No frequent flier miles will be earned on any element of prize travel. Prize conditions may be added or modified by Sponsor or its designee. Releasees are not responsible for any changes of any element of Grand Prize travel and Releasees are not liable for any expenses incurred as a consequence of flight cancellation or flight delays. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Travel is subject to capacity controls, availability, blackout dates and certain other restrictions, which may include a Saturday night stay, all of which are subject to change.
No stopovers are permitted on tickets issued as a prize; if a stopover occurs, the prize will terminate and full fare will be charged from the stopover point for the remaining trip segments, including the return. Once hotel and flight arrangements have been confirmed, no changes will be allowed except by Sponsor or its designee.
An unclaimed and/or unused Grand Prize travel package will remain the property of Sponsor or its designee.
FIRST PRIZE (Twenty-five [25] will be awarded): Each First Prize consists of one (1) "aerie in love" fragrance. The ARV of each First Prize is $34.50 USD (approximately $36.80 CAD).
Prizes are non-transferable, assignable and have no cash value. No prize substitution or cash redemption allowed by a prize winner. Sponsor reserves the right to substitute a prize of comparable value if advertised prize becomes unavailable. Prizes may not be sold, bartered or exchanged by winners. Prizes are provided "as is" and without any warranty of any kind. By accepting a prize, the prize winner acknowledges compliance with these Official Rules.

These terms and conditions apply to all aerie Gift Cards.
1. aerie Gift Cards are not redeemable for cash; except where required by law.
2. aerie Gift Cards carry no expiration date; unless otherwise indicated by AE.
3. aerie Gift Cards can be used for multiple purchases.

The aerie gift card can be redeemed for merchandise only at any AE or aerie stores as well as at AE.com and aerie.com, unless otherwise required by law, or by calling 1.888.232.4535. This card cannot be redeemed for cash or applied as payment for the AE credit card, unless otherwise required by applicable law. To redeem online, enter the gift card number and pin number at the payment page of the ae.com checkout. Only one aerie gift card may by redeemed online at one time. All ae.com and aerie.com orders using aerie gift cards at checkout will be processed in U.S. funds. Lost, stolen or damaged gift cards may be cancelled and replaced with a new gift card in the amount of the then remaining balance upon proof (original sales receipt) as required by AE. Acceptance of the card constitutes acceptance of these terms and conditions. The terms and conditions of your aerie gift card are governed by the laws of the state where the card was accepted. aerie gift cards have no service fees and no expiration dates. The aerie gift cards are issued by AE Admin Services Co. LLC.
The total ARV of all prizes to be awarded in the Sweepstakes is $4,862.50 USD (approximately $5,185.63 CAD). The odds of winning a prize are determined by the total number of eligible entries received.
LIMITATIONS ON LIABILITY: Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees\' sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage.
GENERAL: By entering this Sweepstakes, entrants agree that Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases the Releasees from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death). Winner acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.
If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site, cellular telephone number or service associated therewith (or any portion(s) thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor\'s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor will conduct a series of random drawings to award the applicable prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the Entry Site. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE, CELLULAR TELEPHONE NUMBER OR SERVICE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If a dispute arises about who submitted an entry via text messaging, the entry will be deemed submitted by the authorized account holder of the cellular telephone number entered at the time of text messaging entry. The authorized account holder is deemed the natural person who is assigned to a cellular telephone number by a cellular telephone service provider. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the cellular telephone number associated with the winning entry and that all eligibility requirements are met.
If a dispute arises about who submitted an entry on the Entry Site, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.
NOTE: Internet entry must be made by the entrant only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device or software to automate the entry process is prohibited.
